The following Terms and Conditions (the “Terms”) govern your use of the website located at https://avadahomes.com/ (the “Website”) and your reservation and stay at any property managed or represented by Avada Homes (collectively, the “Services”) in the Emirate of Dubai, United Arab Emirates (UAE).
By accessing and using the Website, making a reservation, or staying at an Avada Homes property, you signify your agreement to these Terms, the Privacy Policy, and all other applicable UAE Federal Laws and Dubai Regulations. If you do not agree with any part of these Terms, you must not use the Website or the Services.
“The Company,” “We,” “Us,” “Our”: Refers to Avada Homes, a company operating under the laws of the UAE.
“Guest,” “You,” “Your”: Refers to the individual or entity making a reservation, using the Website, or staying at an Avada Homes property.
“Property” or “Accommodation”: Refers to the specific hotel room, apartment, or other lodging booked through the Company in Dubai.
“Reservation”: Refers to a confirmed booking for an Accommodation.
You must be at least 18 years of age to use this Website and make a Reservation. You agree to use the Website only for legitimate reservations or purchases and not for any other purposes, including, without limitation, making any speculative, false, or fraudulent reservations, or reservations in anticipation of demand.
You are responsible for ensuring that all information provided during the booking process is accurate and complete, including contact details, stay dates, and the number of guests.
All prices displayed are subject to change without notice. Prices may be subject to various mandatory government fees and taxes, including but not limited to, the Tourism Dirham Fee (TDF), Value Added Tax (VAT – currently 5% in the UAE), and any other municipal or federal fees. The final price confirmed at the time of booking will include all applicable mandatory charges.
A Reservation is confirmed only upon receipt of the required payment or deposit. We accept [List accepted payment methods, e.g., major credit cards, Bank Transfer]. You authorize us to charge the specified payment method for all costs associated with your Reservation and any subsequent charges.
In compliance with UAE law, all Guests (including accompanying guests) are required to present original, valid identification upon check-in. Accepted forms are:
UAE Residents/Nationals: Valid Emirates ID Card.
International Visitors: Valid Passport with an entry stamp or visa (if applicable).
Failure to provide valid identification may result in the refusal of check-in with no refund.
Policy: Cancellation and amendment policies vary based on the rate type (e.g., non-refundable, flexible) and are explicitly stated during the booking process.
No-Show: Failure to arrive on the scheduled arrival date without prior notification will be treated as a “No-Show.” In this case, the full cost of the stay will be charged (or the deposit forfeited), and the Reservation will be cancelled in its entirety.
Refunds: All refunds, if applicable, will be processed back to the original method of payment. Processing times may vary depending on the banking institution.
You must adhere to the Property’s specified check-in and check-out times. [Specify standard times, e.g., Check-in is 3:00 PM, Check-out is 11:00 AM].
You are financially responsible for any damage, loss, or theft caused to the Property, its contents, or common areas by you or any member of your party during your stay. We reserve the right to charge the credit card on file for the full cost of necessary repairs, replacement, or specialized cleaning.
As a Guest in Dubai, you are obligated to comply with all UAE Federal Laws and local Emirate of Dubai regulations, including laws regarding public conduct, alcohol consumption (where permitted), drugs, and decency. Any illegal activity will result in immediate eviction and reporting to the relevant authorities, with no refund.
Guests must strictly adhere to all House Rules provided for the Accommodation, which include:
Occupancy: The number of guests cannot exceed the maximum occupancy stated in the Reservation.
Smoking: Smoking is strictly prohibited indoors. [Specify penalty for violations].
Noise/Disturbances: Guests must maintain appropriate decorum and noise levels. Excessive noise or disturbances reported by neighbors or property management may lead to eviction without refund.
Avada Homes and its owners, employees, and agents shall not be liable for any personal injury, loss, or damage to your property (including vehicles) occurring at or on the Accommodation, except where such loss or damage is directly attributable to Our gross negligence or willful misconduct, in accordance with UAE law. Guests are strongly advised to secure comprehensive travel and medical insurance prior to their trip.
These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Arab Emirates, and specifically the laws of the Emirate of Dubai. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Dubai.
Avada Homes reserves the right to modify these Terms at any time. We will post the revised Terms on this page, and the “Last Updated” date will reflect the changes. Your continued use of the Website or Services after any such change constitutes your acceptance of the new Terms.
